These Terms of Service (the “Terms”) govern access to and use of the ID Gateway USA website, IDGatewayUSA.com, and the document-related and professional services provided or coordinated by ID Gateway USA (“ID Gateway USA,” “we,” “us,” or “our”). The person or entity using the website or services is referred to as the “Customer,” “User,” or “you.”
Please read these Terms carefully. By accessing the website, requesting a quote, booking an appointment, submitting documents or personal information, making a payment, or using any service, you acknowledge that you have read, understood, and agree to be bound by these Terms and any additional service-specific policies or written agreements that apply. If you do not agree to these Terms, do not access the website or use our services.
1. Acceptance of Terms
These Terms constitute an agreement between you and ID Gateway USA. They apply to your use of IDGatewayUSA.com and to services offered or coordinated through ID Gateway USA, whether requested online, by telephone, text message, email, or another approved communication method.
Additional terms may apply to specific services, appointments, payment arrangements, third-party services, or written agreements. If a separate written agreement applies to a particular service, that agreement may supplement or replace portions of these Terms to the extent of any inconsistency.
2. Description of Services
ID Gateway USA provides or coordinates document-related and professional services that may include:

Service availability, eligibility, geographic coverage, pricing, travel charges, appointment requirements, processing times, and required documentation may vary depending on the service and circumstances.
ID Gateway USA may provide services directly or coordinate services through independent notaries, laboratories, couriers, government agencies, vendors, technology providers, or other third parties.
3. Appointments and Service Availability
Appointments may be requested through the website, telephone, text message, email, or another approved method of communication. An appointment request is not guaranteed until ID Gateway USA has accepted or confirmed the appointment.
You are responsible for providing accurate and complete information when requesting or scheduling an appointment, including the service requested, location, appointment time, document type, destination, and any special requirements.
ID Gateway USA may reschedule, decline, suspend, or cancel an appointment when circumstances prevent us or an applicable service provider from safely, legally, or reasonably providing the requested service. Reasons may include incomplete information, unavailable personnel, unsafe conditions, technology problems, legal restrictions, identification concerns, nonpayment, or circumstances outside our reasonable control.
Additional travel or convenience charges may apply to mobile appointments based on distance, location, time, parking, tolls, waiting time, after-hours service, expedited service, or other circumstances. Applicable charges will be communicated before services are provided whenever reasonably possible.
4. Customer Responsibilities

You should not sign a document before a notary appointment when applicable law requires the signature to be witnessed by the notary. You are responsible for confirming that the requested notarial act, document, authentication, apostille, record, fingerprint submission, test, or verification will satisfy the requirements of the intended recipient.
ID Gateway USA does not guarantee that any particular agency, court, employer, foreign government, institution, or other organization will accept a document or service result.
5. Notary Services
ID Gateway USA provides notarial services only for transactions and documents eligible for notarization under applicable law.
A notary performs the notarial acts permitted or required by applicable law. A notary does not determine whether a document is legally sufficient, appropriate, complete, enforceable, or suitable for your particular situation.
ID Gateway USA and its notaries do not provide legal advice unless the individual providing the advice is separately qualified and legally authorized to do so. You are responsible for obtaining advice from a qualified attorney or other properly licensed professional whenever legal advice is necessary.
A notary may refuse, postpone, or discontinue a notarization when identification, personal appearance, willingness, awareness, document, signature, certificate, witness, technology, or other legal requirements have not been satisfied, or whenever refusal is otherwise required or permitted by applicable law.
6. Online and Remote Notary Services
Online or remote notarization services are available only when permitted by applicable law and when the document, signer, transaction, and circumstances qualify for remote notarization.
Not every document or transaction can legally or practically be completed online. Identity verification, personal appearance, audiovisual communication, technology, recordkeeping, electronic-signature, security, and other requirements may apply.
You are responsible for confirming whether the receiving organization, government agency, court, employer, institution, or foreign authority will accept a remotely notarized document. ID Gateway USA may decline or discontinue an online notarization if legal, identification, technology, document, security, or other applicable requirements cannot be satisfied.
7. Apostille, Authentication, and Legalization Services
ID Gateway USA may assist with apostille, authentication, certification, and legalization processes. Requirements vary according to the document, issuing authority, state or country of origin, destination country, receiving authority, and intended use.
ID Gateway USA does not issue apostilles or control the government agencies and foreign authorities responsible for issuing, approving, authenticating, legalizing, accepting, or rejecting documents. We do not guarantee that a document will qualify for an apostille, authentication, legalization, or certification, or that it will be accepted by a foreign government or other receiving authority.
Government processing times, fees, forms, eligibility requirements, and submission procedures may change without notice. Any processing time provided by ID Gateway USA is an estimate unless expressly guaranteed in writing.
8. Fingerprinting and Drug-Testing Services
Fingerprinting and employment drug-testing services are subject to applicable identification, collection, appointment, employer, laboratory, agency, and regulatory requirements.
ID Gateway USA does not guarantee that fingerprints will be accepted by every requesting agency or that a fingerprint submission will produce a particular result. Fingerprint quality, rejection decisions, processing times, and final determinations may be controlled by a requesting agency or other third party.
Drug-testing results and official determinations are made by the applicable laboratory, medical review officer, employer, agency, or other authorized organization. ID Gateway USA does not control third-party laboratory processing times, testing procedures, results, determinations, or employment decisions.
9. Form I-9 Employment Verification
ID Gateway USA may provide Form I-9 document examination or authorized representative services when properly designated or authorized by an employer.
ID Gateway USA does not make employment eligibility decisions on behalf of employers and does not provide immigration legal advice through this service. The employer remains responsible for completing, maintaining, storing, and complying with applicable Form I-9 and employment-verification requirements.
Questions concerning immigration status, employment eligibility, document selection, or legal consequences should be directed to a qualified immigration attorney or other authorized professional.
10. Records Assistance
ID Gateway USA may assist customers in requesting eligible public, vital, court, or other official records. ID Gateway USA does not issue government records.
Records are issued by the applicable government agency, court, records custodian, or other authority. Processing times, fees, identification requirements, eligibility, availability, and final approval are determined by the issuing authority.
We cannot guarantee that a particular record exists, is available to the requester, or will be released. A records request may be delayed, denied, limited, or rejected by the applicable records custodian.
11. Fees and Payments
Fees vary depending on the requested service, location, travel distance, appointment time, document requirements, government requirements, processing requirements, urgency, and other circumstances.
You will be informed of applicable charges before services are provided whenever reasonably possible. Additional charges may apply for travel, parking, tolls, waiting time, after-hours appointments, printing, witnesses when available, shipping, expedited requests, government processing, courier services, laboratory services, or other special circumstances.
Payment may be required in advance for certain services. You authorize ID Gateway USA to charge the payment method you provide for the agreed service charges and any additional charges that you approve or that are expressly disclosed before they are incurred.
Government fees, laboratory fees, courier fees, shipping costs, and other third-party charges may be collected separately or passed through to you. You are responsible for charges properly incurred in connection with your requested service.
12. Cancellations, Rescheduling, No-Shows, and Refunds
Appointments may be canceled or rescheduled subject to the applicable cancellation policy communicated at the time of booking or payment.
Deposits, travel fees, expedited-service fees, government fees, laboratory fees, courier charges, shipping costs, and other third-party charges may become nonrefundable once travel, processing, submission, purchasing, shipping, or other work has begun, or once the expense has been incurred.
If you fail to appear for an appointment, arrive without required identification or documents, fail to provide required witnesses, do not have the required payment, or cannot proceed because necessary information is unavailable, you may remain responsible for applicable appointment, travel, waiting-time, or other charges.
Refund eligibility depends on the service performed, work completed, expenses incurred, third-party charges, and circumstances of the request. Any refund, when approved, may exclude amounts already paid or incurred on your behalf.
Nothing in these Terms limits any refund, cancellation, or consumer right that cannot legally be limited or waived. ID Gateway USA will comply with applicable law regarding refunds and consumer rights.
13. Customer Errors and Additional Work
You are responsible for providing accurate documents, information, names, addresses, destination countries, receiving-agency requirements, mailing information, and instructions.
ID Gateway USA is not responsible for delays, rejection, additional expenses, or repeated services caused by incorrect, incomplete, altered, expired, illegible, or otherwise unacceptable information or documents supplied by you.
If a service must be repeated or additional work must be performed because of inaccurate or incomplete information, unsuitable documents, missed appointments, unavailable witnesses, incorrect delivery instructions, or other customer-related circumstances, additional service, travel, government, shipping, laboratory, or third-party fees may apply.
14. Government and Third-Party Fees
Certain services require payment to government agencies, laboratories, couriers, shipping carriers, records custodians, vendors, technology providers, or other third parties.
Once such expenses have been paid or incurred on your behalf, they may be nonrefundable even if your document, application, test, record request, apostille, authentication, or other request is later rejected, delayed, withdrawn, canceled, or not completed.
ID Gateway USA does not control third-party pricing, policies, processing requirements, decisions, refund practices, or service availability.
15. Processing and Turnaround Times
Processing, completion, shipping, appointment, or delivery times provided by ID Gateway USA are estimates unless expressly guaranteed in writing.
Government agencies, courts, laboratories, records custodians, shipping carriers, foreign authorities, technology providers, and other third parties may experience delays beyond our control.
An expedited or priority-service fee does not guarantee that a government agency, shipping carrier, laboratory, foreign authority, or other third party will complete a request by a particular date.
You should not make irreversible travel, employment, legal, financial, immigration, or other arrangements based solely on an estimated processing or delivery date.
16. Shipping, Mailing, and Courier Services
Documents may be transported through USPS, FedEx, UPS, independent couriers, government agencies, or other third parties.
To the fullest extent permitted by applicable law, ID Gateway USA is not responsible for delays, loss, damage, theft, misdelivery, or other events occurring while documents are in the possession or control of an independent shipping carrier, courier, government agency, or other third party.
You are responsible for providing complete and accurate shipping and delivery information. Additional shipping insurance, tracking, signature confirmation, or expedited delivery services may be available for an additional charge.
You should retain copies of documents before submitting originals and should request tracking or signature confirmation when appropriate.
17. No Legal Advice or Document Selection
ID Gateway USA is not a law firm and does not provide legal advice.
Unless specifically authorized by applicable law, ID Gateway USA does not select legal documents for customers, determine which legal document or notarial act a customer should use, interpret legal documents, advise customers about legal rights, or advise customers regarding the legal consequences of signing a document.
You are responsible for ensuring that your documents have been properly prepared and are appropriate for their intended purpose. Questions concerning legal rights, immigration matters, document preparation, legal consequences, or the appropriate document to use should be directed to a qualified attorney or other properly licensed professional.
18. Right to Refuse or Discontinue Service
ID Gateway USA reserves the right to refuse, suspend, postpone, or discontinue a service when reasonably necessary or permitted by law.
Reasons may include suspected fraud, unlawful activity, identity concerns, questionable document authenticity, safety concerns, abusive or threatening behavior, nonpayment, incomplete information, inability to satisfy legal requirements, technology failures, or a request outside the authorized scope of the service provider.
We may also refuse or discontinue a service when completing the request could violate applicable law, professional requirements, governmental regulations, or the policies of a third-party provider.
19. Independent Notaries and Service Providers
Where applicable, notaries, couriers, laboratories, vendors, technology providers, or other professionals providing services through or in connection with ID Gateway USA may operate as independent businesses or contractors and may not be employees of ID Gateway USA.
Each independent professional or third-party provider is responsible for performing services in accordance with applicable laws, regulations, professional requirements, contractual obligations, and its authorized scope of service.
The use of an independent provider does not expand the scope of services promised by ID Gateway USA or create an employment, partnership, joint-venture, or agency relationship except where expressly established in writing.
20. Third-Party Websites and Services
Our website or services may involve or contain links to, integrations with, or references to government agencies, laboratories, payment processors, shipping companies, technology providers, foreign authorities, and other third-party services.
ID Gateway USA does not control and, to the fullest extent permitted by law, is not responsible for the availability, content, policies, security practices, products, services, decisions, or practices of independent third parties.
You should review applicable third-party terms of service and privacy policies before using a third-party website or service.
21. Electronic Communications
By contacting ID Gateway USA through the website, email, telephone, text message, online booking system, or another communication method, you consent to communications reasonably necessary to respond to inquiries, schedule or manage appointments, provide requested services, request necessary information, process payments, and communicate regarding an existing transaction.
You are responsible for providing accurate contact information and for ensuring that you can receive service-related communications.
Consent to service-related communications does not constitute consent to marketing communications where separate consent is required by law. You may opt out of marketing communications in accordance with applicable law and the instructions provided in those communications.
22. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the website and services are provided on an “as is” and “as available” basis.

23. Limitation of Liability

ID Gateway USA is not responsible for losses caused by circumstances outside its reasonable control, including government delays, third-party processing delays, shipping disruptions, incorrect customer information, changes in governmental requirements, technology failures, laboratory or agency decisions, foreign-authority decisions, or decisions made by receiving organizations.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability that applicable law prohibits the parties from disclaiming.
24. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless ID Gateway USA and its owners, officers, employees, agents, contractors, and service providers from and against claims, losses, liabilities, damages, judgments, costs, and expenses, including reasonable attorneys’ fees, arising out of or relating to:

25. Intellectual Property

Except where applicable law gives a customer the right to bring an action elsewhere, any court proceeding arising out of or relating to these Terms or the services will be brought in the state or federal courts located in or serving Burlington County, New Jersey, and each party consents to the personal jurisdiction and venue of those courts.
Nothing in this Section waives or limits any consumer-protection right, small-claims right, statutory right, or other right that cannot lawfully be waived or limited. If applicable law requires a dispute to be brought in another court or permits a customer to bring a claim in another lawful forum, that requirement or right will control.
29. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remaining provisions will remain in effect.
30. No Waiver
ID Gateway USA’s failure to immediately enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision later. A waiver is effective only if made in writing by an authorized representative of ID Gateway USA.
31. Entire Agreement
These Terms, together with the Privacy Policy, applicable cancellation and refund policies, service-specific policies, appointment confirmations, quotes, invoices, and other written agreements relating to a particular service, constitute the entire agreement between you and ID Gateway USA regarding the website and services.
If a separate written agreement applies to a particular service, that agreement may contain additional or different terms. In the event of a conflict, the specific written agreement will control to the extent of the conflict.
